Terms of Use

The rules for using this Site and how a Roadster reservation works.

Please read carefully. A reservation made on this Site is a free, non-binding expression of interest. It is not an order, not a purchase contract, and does not guarantee price, specifications, availability or delivery. No payment is collected on this Site.

1. Acceptance of these Terms

These Terms of Use ("Terms") govern your access to and use of reservation-roadster.us and any related pages, forms and communications (together, the "Site"), operated by [COMPANY LEGAL NAME] ("we," "us," or "our"). By using the Site or submitting a reservation, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old and a resident of the United States (the 50 states or the District of Columbia) to submit a reservation. By submitting one, you confirm that the information you provide is accurate and that you are submitting it for yourself and not on behalf of someone else without their permission.

3. Reservations

  • Non-binding. A reservation records your interest and your place in line. Neither you nor we are obligated to buy or sell a vehicle as a result of it.
  • No payment. We do not request or accept card, bank or other payment details on this Site. Any future purchase would be made only under a separate written agreement that you sign, which will contain its own terms.
  • Order of contact. We intend to contact reservation holders in the order reservations are received, but timing may vary by region, configuration, production capacity and legal requirements.
  • No guarantee. A reservation does not guarantee any particular price, configuration, production slot, allocation, delivery date or that the vehicle will be offered in your area.
  • Our discretion. We may decline, limit or cancel any reservation, including duplicate, incomplete, fraudulent or automated submissions, or if we decide not to offer the vehicle.
  • Cancellation by you. You may cancel at any time, free of charge, by emailing [email protected] from the address you used.
  • Non-transferable. Reservations are personal to you and may not be sold, assigned or transferred.

4. Product information

All vehicle images on the Site are illustrations. Specifications, performance figures, features, colors, options and timing are preliminary targets, are provided for general information only, and may change without notice before production. Performance figures are targets under controlled conditions and actual results will vary. Always obey traffic laws and drive responsibly. Nothing on the Site is an offer to sell a vehicle, and any pricing will be confirmed only in a written agreement.

5. Communications

By submitting a reservation, you agree that we may contact you by email about your reservation. Marketing emails are sent only if you opted in, and you can unsubscribe at any time.

If you opt in to calls and text messages, you agree to receive calls and recurring text messages about your reservation at the number you provided, which may be sent using automated technology. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel and HELP for help, or email [email protected]. Wireless carriers are not liable for delayed or undelivered messages.

6. Acceptable use

You agree not to:

  • submit false, misleading or someone else's information, or reservations through bots or other automated means;
  • interfere with or disrupt the Site, its servers or networks, or attempt to gain unauthorized access to any part of them;
  • scrape, copy, frame or mirror the Site, except as permitted by your browser for ordinary viewing;
  • use the Site to transmit malware, spam or unlawful, harassing or infringing content;
  • impersonate us or misrepresent your affiliation with us, including asking others for payment in our name;
  • use the Site in violation of any applicable law.

7. Intellectual property

The Site and its content — including text, graphics, illustrations, logos, designs, page layouts and code — are owned by or licensed to us and are protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view the Site for your personal, non-commercial use. Any other use requires our prior written permission. All rights not expressly granted are reserved.

8. Feedback

If you send us ideas, suggestions or other feedback, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use it for any purpose without obligation to you. Please do not send confidential information.

9. Third-party links and services

The Site may link to third-party websites or rely on third-party services (such as hosting, fonts or form processing). We do not control and are not responsible for third-party content, products or practices, and links do not imply endorsement.

11. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT INFORMATION ON IT IS COMPLETE OR CURRENT. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO THE SITE OR A RESERVATION. BECAUSE NO PAYMENT IS MADE THROUGH THE SITE, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR A RESERVATION WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.

14. Governing law and disputes

These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-laws rules, except where the law of your state of residence requires otherwise. Before filing a claim, you agree to try to resolve the dispute informally by emailing [email protected]; we will try to do the same. If a dispute is not resolved within 60 days, either party may bring it in the state or federal courts located in [STATE], or in small-claims court where you live if the claim qualifies. Nothing here waives any right you have under consumer-protection laws.

15. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above shows when they last changed. Material changes will be announced on the Site or by email before they take effect. Changes do not apply retroactively to disputes we already know about.

16. Suspension and termination

We may suspend or end your access to the Site, or cancel a reservation, if you violate these Terms or if we stop offering the Site or the vehicle. Sections that by their nature should survive (including 7, 8 and 11–14) will survive.

17. General

These Terms, together with the policies they reference, are the entire agreement between you and us about the Site. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
